The Full Story

A plain summary built from the channels that reported this story. Facts only one channel reported are attributed to it.

Bright Horizons failed to tell Ofsted about an internal investigation into nursery worker Vincent Chan in 2021, despite a legal duty to report serious concerns, it has emerged.

Chan filmed himself abusing several young girls between 2022 and 2024 while working at the nursery. He was later jailed after pleading guilty to various sexual offences.

The investigation into Chan took place in 2021 after a parent raised serious concerns about his conduct. It was internal. The details were never shared with Ofsted. The Early Years Foundation Stage framework from 2021 sets out the requirement. On page 23, it says registered providers must inform Ofsted of any allegations of serious harm or abuse by any person living, working or looking after children at the premises.

The parents of Chan's victims said the failure was shocking. One said a large company that should know the rules and the law did not carry out its legal responsibility to notify Ofsted about Chan's actions in 2021. They also said the failure may have delayed regulatory action. If Ofsted was not told, it could not decide whether to inspect earlier or carry out a regulatory inspection. In this case, that could have put inspectors in the setting before 2022, when Chan began offending.

Bright Horizons said it takes its Ofsted notification requirements seriously and has policies and procedures in place to facilitate compliance. It said the safety and well-being of the children entrusted to its care is of paramount importance. It added that it is truly sorry for the impact of Chan's crimes on the children and their families.

When asked why it failed to notify Ofsted, Bright Horizons did not give a direct answer. Parents said the revelations raise more questions, including what else may not have been reported. They said the case has been re-traumatising and that they are still pushing for change.

The UK's third largest nursery provider has not explained the gap between its legal duties and what happened in 2021. The case has renewed scrutiny of how childcare providers report concerns to the regulator and whether earlier action could have been taken.

Channel Perspectives

What each channel focused on, with key quotes.

ITV

ITV1 built its coverage around an exclusive investigation and a clear accountability question: why a large nursery provider did not meet its legal duty to notify Ofsted. The lunchtime bulletin focused on the 2021 parent concern, the internal inquiry, and the impact on victims' families. The evening bulletin added the Early Years Foundation Stage wording, pressed Bright Horizons on the missing notification, and widened the questions to what else may not have been reported. The tone was serious and sceptical of the provider's response.

Key Quotes:
  • “We find it absolutely shocking that this big corporate that should know the rules, that should know the law, didn't do their legal responsibility to notify Ofsted of Vincent Chan's actions in 2021.”
  • “If Ofsted wasn't notified, they are then unable to make a decision as to whether to inspect earlier or to do a regulatory inspection”
  • “What other people are falling through the cracks in this system?”
